Mom sues Applebee's for serving her 5-year-old son a Long Island Ice Tea
I hate Applebee's. I hate everything about Applebee's, what the company represents ("neighborhood"
restaurants in strip malls?), the food they serve, and in particular I hate Applebee's because my parents insist we go
there every time I come home. I always say, "Isn't there some local restaurateur whose place of business we could
support, preferably not something in Target's parking lot?" And my mom says, "But I just love their
Chinese chicken salad." To which I respond by saying something about how the Chinese don't eat chicken salads.
Well, you can imagine my delight when I read the story about the Applebee's Neighborhood Bar and Grill™ in Battery Park City, New York that is being sued for $75,000 by a woman who claims the friendly neighborhood bar and grille served to her 5-year-old child a delicious concoction of white rum, gin, vodka, triple sec, Coke and sweet-and-sour mix instead of the apple juice she ordered. The mother, Cynthia Pereles, claims her son's eyes became glazed over an dhe started laughing uncontrollably. "When you're looking at your 5-year-old and you're asking him, quiet down Seth, sit still and you see that mentally and physically he cannot comply with what you're asking him to do because he is under the influence," Pereles said without finishing her sentence. I'll finish it for her, "you'd best sue the cheesy wall-decor off your local neighborhood Applebee's and show me the money."

Kris said...There was a stupid mistake! If a 5 yr old spoke up with a concern it sounds like the parent dropped the ball. How much did this kid drink? Applebees may not be the greatest place, but people have jobs and no one is perfect. When a child is young, parents should pay attention to their child's food and I guess even more so with their drink to make sure is not sour milk or alcohol!

Lynn said...OK, I am a server at Applebee's and I have some things to say. First, if this really happened then action needs to be taken. What you need to understand is that the server rings up the drink and the bartender makes it, the server does not handle the making of the drinks. Are food is not over priced at all. We have a great Happy Hour, and if you can not afford $3.50 for some GREAT boneless wings then stay at home. Everyone that works at my Applebee's loves it there, we are a great team, and if something like this really happened then everyone is feeling for the people that were involved. Now, for the mom, you can not tell me that you could not smell the Long Island on the kid...come on now...Applebee's has so many regulars that there is no way that we will ever go out of business...I now have worked at 8 different stores in 4 different states, and every Applebee's is alittle different, but for the most part we are a GREAT place to come to, and to bring your kids....just not past their bed times....kids need to be home...so sue yourself with lack of parenting.....

Peggy glover said...I like Applebee's. I would think that mother should have been able to tell the difference between apple juice and a alcoholic drink. Some of these complainers are those that are causing good restaruants to close like a tony roma's or an applebee's and are opening too many mexican restaruants in their place around the country.

I work at Applebees in Maryland. Although we are a different corporation than this Applebees in the story. (STORY) I feel as though it would be EXTREMELY difficult for a bartender to mistake a long island tea for an apple juice. MAIN REASON BEING that kids drinks are served in tiny colorful KIDS CUPS. No bartender at our store EVER put alcohol anywhere near one of those cups. This story is absurd and untrue.
PS. I can understand why some of you might not like Applebees, but the shit we have to deal with as servers is insane. You try having 7 tables at a time and listening to the same shit about your steak being overcooked or your soup being "lukewarm". FOR THE RECORD, we don't cook the DAMN food. We listen screaming kids and get tipped 2.00 on an 80 dollar check. FYI Applebees servers have to a) run food, b) do sidework including filling ice, filling dressings, stacking clean cups, sometimes even expoditing their own food, c) at my store I have to do CARSIDE and SERVE at the same time, d) serve your dumbasses. So next time we look like we're running around with our heads cut off, you'll know why. If you don't like the food, don't come. It's as simple as that.
Not to glorify the restaurant in anyway, because given the option, I'd chose Outback, but working at any restaurant is hell, Applebees or not.

Jen said...The mistake is an easy one if the bartender makes alcoholic drinks for employees and puts them in kid cups. I bartended at applebees, and alcohol NEVER goes in kid cups. I know some bartenders who would give friends drinks in kid cups throughout the shifts (some with alcohol) so I'm sure this kid cup of fun was waiting for a server to drink it, and another server didn't realize that and innocently took the cup to the table. Stupid, Yes... Surprising, No. Overall, it's a rare situation and that Applebees will most likely be in quite a bit of trouble. I don't think it will affect Applebees in general. Mistakes happen. It stinks that a kid had to suffer for the ignorant bartenders mistake.

Comment 1- ADA rules are mandated by each particular county. They would not have been allowed to open the restaurant if they didn't comply, take it up with the county.
Comment 2- You may find it overpriced, but actually it is quite competitive in the casual dining industry. In fact, the reason that it is not cheaper is because we have to charge more to compensate for scammers that try to sue or get free meals everyday.
Comment 3-There were no casual dining restaurants at all 50 years ago because the market could not bear it and most people cooked.
Comment 5-Your statement is so dumb that it barelly warrants a response. But, here goes. 75,000 is a drop in the bucket for a company as large as Applebee's. If that amount of money hurt them, then you wouldn't have to worry about the food or service because we would be out of business.
Take your kid to McDonald's and don't bring him to a neighborhood "bar."
This restaurant started out as a bar, we are still in the bar business.
It shouldn't have happened (if, in fact it really did). I have not heard anything about this until this blog, so it is probably a farce.
Bottom line: Nobody deserves 75g's for a couple of sips of long island iced tea.
What's next? the guy who didn't get his Tea going to sue for getting apple juice?
Give it a rest. This lady is a loser, and won't win a dime.
