Ask a nine-year-old what drugs are and you are likely to hear things like cigarettes, marijuana, even alcohol. But I think you would be hard-pressed to find a kid - or an adult - who would categorize Vitamin C as a drug. Unless you were Khalin Rivenbark's fourth-grade teacher. The Clay County, Florida teacher has accused the Khalin of not only possessing the Vitamin C drug, but selling it as well.Khalin had been fighting a cold, so her father put a bag of Halls Defense Vitamin C cough drops in her backpack. When two of Khalin's classmates asked for one of those cough drops at school, she says she handed them over. But her friend insisted on paying her for the drops. "She felt guilty taking the cough drop or whatever, so she gave me a dollar. I didn't want to accept it, but she had me take it," Khalin said.

That's when things turned ugly. Khalin says her teacher witnessed the transaction and came down hard. "She saw me with the cough drops out and I guess she saw me give it to one of my friends, and then like, 'Oh, I see this good business going on around you,'" Khalin said. "She said, 'You're selling drugs.' (I said) 'No I'm not.'" Khalin and her classmates are now facing possible punishment over the incident.The Clay County Schools handbook addresses the issue of kids taking of prescription and over-the-counter medications at school: "If a student must take a prescription or over-the-counter medication during school hours, it must be received and stored in the original container, and be labeled with the student's name, current date, prescription dosage, frequency of administration and physician's name."
So, the question here is whether or not Halls Defense Vitamin C cough drops are considered an over-the-counter drug. According to a local news reporter, the ingredients in the cough drops are almost identical to those in a Lifesaver candy and do not include menthol. This would seem to indicate, at least to me, that Khalin did nothing wrong and is being unfairly accused of being a drug dealer.
I appreciate the fact that school teachers must make judgment calls on a regular basis. But in this case, it sounds like the teacher rushed in making her judgment.

The level of intelligence of the majority of society is shameful but has anybody ever noticed that the more power, influence, education or money a person claims to have the less common sense they seem to possess. For example my husband works for a major University. The physical manager decided to remove all campus ash trays a couple of months ago and now he can't figure out why there are cigarette butts everywhere. Can we say stand up and remove head from posterior!!! Wake up America. Learn to prioritize and figure out what's really important not what makes you look good or benefits you. Life isn't just about YOU!!!

How will our kids trust a system that says "guilty until proven innocent?" No wonder parents are turning on the school systems and looking to home-schooling or other sources. If I were that parent, I'd be looking to a slander complaint - charging my kid falsely with a felony and denigrating my family name...but it would accomplish nothing...who is teaching the teachers and how in the world did they ever pass?

Dawn said...For those of you blaming the teacher(under paid NOT overpaid), think about this. If one of the classmates that had been given the cough/vitamin C drop had an allergic reaction and suffered a serious or possibly fatal reaction, would you then think the teacher over-reacted? Teachers are in the classroom not only to teach but to insure the safety of all their students. Clay county students are given a student handbook at the start of each academic year, detailing the county's policies, not to mention no gum, candy, etc. should be consumed in the classrooms. If parents would spend time with their children and review the handbook, the father of this child would have been aware that the drops were not allowed! Don't blame the teachers who are forced to go beyond what is expected of them, blame the parents that encourage and support their children in defying school rules and policies.

heidi said...it is not drugs but the child cant be giving or selling them. what if another child started choking on one, then the parents of the child will sue the school,the teacher and maybe the child's parents. my children are not allowed to give other children anything or take or buy anything from anyone unless it is from the school itself. people sue all the time for the stupidest things, i cant really blame the teacher.i would not allow it either.

starchildlucy said...That's all fine and good, but when my kid's "EMERGENCY" inhaler is locked up in the school nurse's office and the door is locked, it doesn't do a heck of a lot of good - and of course the ambulance run that becomes necessary because he can't take his medication is charged to my insurance...parents are not asking to give the kid "carte blanche," we asking that a little "common sense" be employed - but I guess we can find that on the "Endangered Species Registry" as well...

This has got to be absolutely the most ridiculous and emotionally harming incident from a "SO-CALLED ADULT" that I have EVER heard of! I think this "teacher", which this word needs to be used lightly...needs to be publically humiliated and her reputation tarnished by being accused of selling drugs, even if she did not. We, as adults, sit around and wonder why the youth of today are so extremely angry.......Gee I wonder why.

Kathy said...I agree, that when a school has rules regarding dispensing meds through the nurse, that parents should abide by these rules. But this does not give the teacher the "RIGHT" to emotionally damage this child by wrongly accusing the child and making her feel like a criminal! This was NOT a criminal act, and let us as adults here, be honest and clear in our words and actions to these children. Call it what it is.....giving a friend a cough drop! This is in NO WAY a drug....I mean if it were a drug....then every human being would be on drugs and would have sold drugs.....but we all know that is not true. The bottom line is that the parent made a mistake in judgment regarding not going through the proper channels of dispensing meds to your child through the school nurse. This should have been handled quickly and privately directly with the parent, by reminding them of the rules and then just simply taking the cough drops from the children. THAT'S ALL.

Clay County needs to get on the ball and review her and her abilities. One teacher there screams at the top of her lungs at the students, another never returns calls or notes, and on and on. This school may be an "A" school, but it gets an "F" in my book ! GET WITH IT CLAY COUNTY AND REVIEW NOT ONLY THE TEACHERS BUT ASK THE PARENTS AND THE STUDENTS WHAT THEY THINK !

K. said...The fact is that teacher makes far more than minimum wage. The minimum wage staff at any fast food place knows the difference between Hall's cough drops and illegal drugs. WHY doesn't she? Sad.
