The 12-year-old girl's parents are divorced; in the spring of 2008, the girl's mom gave her permission to go on a class trip to Quebec City in June. But the middle-schooler lived with her father, and after she disobeyed daddy's orders to stay off the Internet, he told her she couldn't go. So what did she do? She took him to court. Of course.
A lower court ruled in favor of the girl, who went on the embattled class trip. Her father appealed -- on principle - -and amazingly, the girl won again. The father's attorney, Kim Beaudoin, says that her client is "flabbergasted" and they are considering another appeal, this time to Canada's Supreme Court. But, the attorney adds, the father has no regrets about the court proceedings. "Either way, he doesn't have authority over this child anymore. She sued him because she doesn't respect his rules," Beaudoin said. "It's very hard to raise a child who is the boss."

Now, I don't know a lot about the law, but I watch enough "Law & Order" to know that one thing that counts in the legal world is precedent. CBC News says that "the appeal court warned [that] the case should not be seen as an open invitation for children to take legal action every time they're grounded." But here's thing: If you don't want someone to consider using your ruling in other cases, maybe you shouldn't make the ruling. And what could the judge's reasoning possibly have been? Lucie Fortin, the Legal Aid lawyer who helped the girl take her pops to court, said that "The trip was very important" to the daughter. How is that a legal argument? Don't parents have the right to punish their children? (This is like making Consensual Living a legal requirement.)
Sadly, the case has destroyed the relationship between the girl and her father. "We went from a child who wanted to live with her father, and after all this has been done, they're not speaking anymore." The father's attorney adds, "We have a lot of work to re-establish a link between those two."

yash said...I woulda beat that lil' girl. And I woulda beat everyone in that court room too. They're all crazy. What makes me uneasy about this whole thing is how can the court later on convict people for breaking the law because won't people just be able to argue that the law was too harsh?

Anna said...I totally agree with everyone - this case had nothing to do in court. The girl hasn't been abused in any way. On the contrary, she herself broke the rules.
The tendency to "protect" children this way scares me a bit... I'm not sure I want to have kids if I can't discipline them, if I have to support them and they can then dictate me what to do. No, no, no. No kids.

Ellie said...He might as well let her stay with her mother. The court system has destroyed any possibility of his having a respectful parent -child relationship with her. Maybe she will sue her mother also and end up in foster care. Wait until she finds out that there will be so many more times in her lifetime that she won't get her way. Oh, wait, she will just sue.
When this child is completely out of control, maybe the parents can sue the court that made it possible. This child will feel as if she rules the universe and doesn't have to take any orders. I hope this judge will be around to see the outcome of his very bad decision.
My favorite child psychologist, Dr.John Rosemond is just shaking his head in disbelief as are most parents.

marilyn said...How old are you? In emotional years, I would say 10. The mom and dad are not the problem. I think the judge should take responsibility for any misdeeds the young lady makes in the future. After all, he decided in her favor and enacted her lack of respect for authority. He should raise her.

Well IF it IS then my say is that we kids do have rights. this conflict could have became much worse as time gos on. i have a grudge towards my mother, for an example, and that conflict happened years ago and i still have not forgave her for what she done to me. this could have grown into a domestic violence case at the worse if the kid has rebelled toward the father, in a particular way. be happy people that the kid went to the court.
parents in my eyes have power to discipline us, just as long as the punishment is relative to the act the kid has violated. banding the kid from the school trip was impulsive and irresponsible. the patent should have punished her in some way related to the computer, within limits (we have fragile lives on line, and our lives are greatly connected with the computer, and the computer can greatly impact our real lives).

Pierpoint Windsor said...I know a family where the obese mother gave her kids permission to ignore the father-both kids are now adults-both still spoiled and immature and the obese mother deceased/ These two 'kids' called the police on their father who was at what was the mothers condo but reverted to him upon her demise-becuase on the evening prior to the funeral he lit a cigarette within HIS condo. The judge in the above case is errant-a twelve year old should never even have the right to sue. Certainly we would not want to see kids who are abused having no recourse to justice-but in this case logic indicates the father decision was fully in line to ground his 'little' girl. The judge has now created a situation where a child is now and possibly ever damaged and estranged from her 'DADDY'. SHAME ON YOU JUDGE!

They control the punishments, and if the girl thinks the punishment is unreasonable, she can talk to her mother or father. What happened to the fact that the parents have the authority? This must be some bossy, bratty, drama queen, attention-striving kid. I can't even tell you how stupid this is. And the point of sueing is??? Well, she damages her relationship with her dad, and everyone who reads this thinks she is an idiot, all just so she is ungrounded for something she needs to be punished for. STUPID STUPID STUPID

rmirod said...An undisciplined child learns to be that way from adults who pamper dishonesty and disobedience. In this case the child is guilty of both those infractions and should have suffered the removal of the computer from her access. The grounding though an act of authority didn't relate to the infraction as removing her access from the device.
As the father of this child she should be counseled in how destructive her actions have been to herself and her relationship with her father. If it were me I wouldn't trust this child ever again and would place her in a educational institution not in my home town.

frank said...The lawyer who took the case should have been sued and the judge should have never showed up. This is a family matter and should have been handled as such. Of course the dad didn't have to take such drastic measures but the problem with most kids today is that they are not paying the consequences for their actions. It is bad news for mankind when we allow other people to make decisions regarding our family. This judgememt sends the wrong message to our children. If there has to be a law it should be that one family member should not be allowed to sue another family member because the emotional involvement in the family should pose a conflict of interest. A more sensible judgement would have been at least to allow the dad to impose some alternate punishment to get the point accross to the child that she is not getting away with her disobedience.

Patricia said...There is enough blame to go around: The court was wrong to hear the case. The parents were wrong for not consulting about this infraction and punishment. The daughter was wrong for being disrespectful to her parents. This case should have been referred to family counseling. I thank God that we did not have to raise our child with this kind of disagreement about parenting.
