An extra wide smile is unacceptable? I wonder how many pictures in the yearbook have scowling faces. There are usually many. I would much rather see a beaming smile than a grumpy frown. This schools administration has to grow up!!!!!

They have to nip this kind of thing in the bud. Otherwise valley girls will be running wild in the streets. The mall won't be safe for anyone.

As a former prosecutor (out of state), I see two liabilities for
the school.

If the school does not have clear guidelines prohibiting the type
pose at issue here, the student may have some first amendment claims.
Even where the school gets editorial control over publications, this
is an issue the school should lose on if they do not give her a
retake on the photo, if the issue is put before a judge (on what
would be an administrative mandamus action where I am from).

Secondly, I think the school may have committed a serious tort
(personal injury), defamation or libel, by claiming that the girl's
pose indicates a gang affiliation. The girl and her mother should
consult an attorney in her area to have a full exchange of the facts
and the legal rights at issue.

Its ashame schools dont let kids be kids if she wants to have a goofy picture so what she is not hurting anyone. This is why the school drop out rate is getting so high. they push kids out. its very sad..

I agree with you. I am embarassed to be part of the group supposedly in charge of this country (40-50). We are completely stupid and over the top with ridiculous rulings and seem to have lost ALL common sense! I think 15 yr olds have more common sense then administrative officials today...oh and parents too. stupid stupid stupid.

@Greg: Last time I checked, students AND their parents have to pay taxes. Is that what we pay our taxes for? Security officers that are so unfit they can't even catch up with high schoolers... teachers who assign bookwork as a form of teaching... abandonment of ALL our rights when we enter school?
Maybe the school could have worked something out with their photographers and allow her to retake her photo at the very least... since she claims she never was offered a retake.
