Mother Of Nine Says She Was Sterilized Against Her Will

She wanted doctors to give her a birth control device. Instead, Tessa Savicki of Springfield, Mass., says they sterilized her.
Savicki claims doctors performed a tubal ligation on her without her consent. Now, the 35-year-old mother of nine is suing Baystate Medical Center in Springfield, as well as three doctors and two nurses.
Savicki's nine children range in age from 3 to 21. She tells the Boston Herald she wanted doctors to implant an intrauterine device after the birth of her son, Manuel Flores, in 2006. She specifically wanted a device that would be removable in case she wanted more children, she tells the newspaper. Instead, according to papers filed in Hampden County Superior Court on Nov. 24, 2009, doctors performed the tubal ligation.
The Herald reports Savicki receives medical insurance under the MassHealth program. Under state and federal rules, a MassHealth patient must give written permission for permanent sterilization at least 30 days before the procedure. Savicki claims she never gave that consent.
"There was no medical reason for them to do this," she tells the Herald. "That's my choice. This is my body. I wanted the IUD, so later if I felt I wanted more children, I could have more."
Hospital spokeswoman Jane Albert wouldn't comment on the case. "There's pending litigation. We can't comment, and that holds true for the doctors," Albert tells the Herald.
Savicki's lawyer, Max Borten of Waltham, Mass., tells the Herald that the hospital's treatment of his client amounted to a "total breakdown of protocols."
"There were violations at many, many levels," Borten tells the Herald. Borten is a former obstetrician and gynecologist who practiced for more than 30 years in Massachusetts.
In response to a request for her medical records, a former attorney for Savicki received a letter from the hospital last May that stated: "We regret to tell you that in spite of carefully and thoroughly searching, we have been unable to locate the following medical records: 'Tubal consent form for December 2006.' "
Albert confirms for the Herald that the document was signed and sent by an employee in the Health Information Management System Department.
Physicians named in the suit include Michael P. Plevyak and James Kuo Chang Wang, as well as a third physician who, the Herald reports, has not yet been served.
In court documents, Savicki claims she suffered "substantial pain and emotional distress and incurred severe and permanent physical injuries."
Savicki tells the Herald she brought the IUD into the operating room, unopened and in a box, on Dec. 19, 2006. She adds that she handed the box to the nurse prior to a planned Cesarean section.
Surgical notes reviewed by the Herald indicate she received a tubal ligation.
In 2001, the newspaper reports, Savicki reached an out-of-court settlement with CVS pharmacy and a spermacide company after she claimed she was sold an expired spermacide.
The Herald reports Savicki's nine children have several fathers. She reportedly is unemployed and relies on public assistance for two of the four children who live with her.
She receives supplemental security income for non-Hodgkin's lymphoma, she tells the paper. Her mother has custody of three of her children, according to the Herald. Two of her children are grown.
Savicki tells the paper she realizes she might not cut the most sympathetic figure in the public eye, but basic rights are at stake.
"I would never have the right to tell anyone else 'because you have this many kids that's enough,' " she tells the Herald. "That's no one's right to say that. It's my choice. No one has the right to say you've had enough. I take care of my kids. I love my kids. I was not ready to make that kind of decision."

When they're getting public assitance paid for with taxpayer money from gals who don't go overboard with the baby making. If i have to limit my family size because of cost, so does she. I wonder how many she would have had if no $. Oh, and you don't love your kids if you don't have the father around.

Heather said...Thanks for being so negative towards EVERY single parent who needs a little bit of help. I agree 9 kids is too much. HOWEVER...I, myself, have 2 small kids (ages 7 &5) that I am having to raise with only the help of a measley $98 a week child support payment on top of working full time. I am not a single parent by choice. My now ex husband cheated (he says he didnt) and walked out on me and the kids just over a year ago. I am doing everything I can to maintain the home we bought together with minimal budget. I needed help but couldnt get it...even tho I was down to 4 day work weeks for 4 months. I have tried to get food stamp assistance and have been denied. But the kids got approved for the Health insurance in my state. Now with winter here, I needed help with my heat bill (through a non profit organization). I also needed help to give my kids a Christmas this year, which gave them enough clothes I wouldnt have been able to provide, for the rest of the winter. (also non profit organization)
Don't put everyone in the same category as this woman. We all have different stories. And it is not shameful to ask for help if you need it. That is why the programs exist. Not to abuse the system, but to use it if needed.

you don't know her story, why she doesn't have the fathers in the picture-- and you don't know my story, either-- the father of my children happens to be a psychotic sociopath, who managed to hide it from me for several years, while we had two children together. i must not love my kids very much, since i kicked him out of our lives.

Sometimes it is BECAUSE you love your children that you DONT have the father around! It is not about your opinion of if she has too many children. It is about having your basic rights and your body violated against your will and someone else making life changing decisions for you. No matter how you feel about how many children she has, what these doctors did was horrific if in fact there was no signed consent!

She is proably dissappointed that her welfare is going to slowly dwindle over the next 16 years as her youngest is 2, what a moron get a job lady do something positive and be someone your kids can look up to and be amazed about. I wouldn't be surprised if her teenage children are going to make her a welfare grandma soon if they have not already, lol bunch of losers....

MIchelle said...I totally agree. People who keep having kids when they don't need to and we are paying for them.
It is so unfair I am married and would love to have a child but have not been able to get pregnant for 7 1/2 years. I could support them and take care them without using taxpayers money.
This lady should be glad they did her a favor!

Kat said...My mom raised me and my sister who is physically disabled all by herself. She was an awesome mom who loved us and supported us after my dad cheated on her and walked away. This mom may love her kids, however her actions show poor decisions. She may be saying it's about "basic rights", and on some level it is. But this is the same woman who had multiple sexual partners and children that are being raised and/or supported by others. She is entitled to have kids, but should realize that if she can't afford them NOT to have them. What the doctors did was wrong, but this being her second lawsuit regarding birth control (CVS), I have to wonder if she's just looking for her 15 minutes of fame ie...Octomom.
