Was Michigan Teacher Wrong to Eject Students for Anti-Gay Remarks?

Someone was bullied in a Michigan classroom on Oct. 20. Exactly who was the victim and who was the bully, however, depends on your point of view.
Popular opinion -- at least as it was expressed at a community forum held Nov. 8 -- says Howell High School teacher Jay McDowell was in the right.
McDowell was suspended for a day, his supporters say, because he defended gay and lesbian students against hate speech. However, district officials say he violated the First Amendment rights of students.
Both sides, though, generally agree on the sequence of events that day.
Many Howell High School students came to class wearing purple T-shirts for Spirit Day, a national effort to oppose the bullying of gay and lesbian young people.
However, a female student came to McDowell's class wearing a Confederate flag belt buckle, instead. McDowell told her to remove it. She did so without defiance.
Then a male student asked why she was not allowed to wear a Confederate flag when other students were allowed to wear purple as a political statement. After McDowell explained his position, he asked the student if he had changed his mind.
The student said no. He still believed homosexuality violated his religious beliefs. At that point, McDowell ejected him from the classroom. Another student then spoke in support of the first student. He, too, was ejected.
Kim Root, a spokesperson for the Howell School District, tells ParentDish, officials learned all this after a thorough investigation. The students were not acting angry or belligerent, she says.
Even McDowell himself confirms this in interviews with the Associated Press and other news organizations.
Root says the district investigation was prompted by complaints from parents about how McDowell handled the students. She says officials suspended him after determining he violated district policies that protect students' freedom of speech.
The incident comes on the heels of highly publicized suicides by gay young people, suicides apparently prompted by bullying.
Emotions were running high at the Nov. 15 community forum before the Howell School Board.
Graeme Taylor, a 14-year-old resident of Ann Arbor, Mich., came to speak in support of McDowell.
"When you hear of things like Dr. King's speech that one day he wanted his grandchildren, his posterity, to not be judged on the color of their skin but on the content of their character, I hope that one day we, too, can be judged by the content of our character and not by who we love," he says in a video recording of the meeting.
"There is a silent Holocaust out there where an estimated 6 million gay people every year kill themselves," he adds.
That number is a bit inflated.
According to national statistics, an estimated 5 million Americans -- gay and straight -- of all ages attempt suicide every year.
David Hudson Jr., a scholar at the First Amendment Center in Arlington, Va., tells ParentDish McDowell is treading on unstable ground, as case law falls on both sides of the debate.
In Minnesota, a student wore a T-shirt in 2001 proclaiming "Straight Pride" and depicting a man and woman holding hands.
U.S. District Court Judge Donovan W. Frank ruled the school couldn't censor a message on a shirt merely because other students find it offensive, unless the shirt will disrupt the school environment.
However, the 9th U.S. Circuit of Appeals in California upheld the right of a school to ban an anti-gay T-shirt in 2007, ruling that gay and lesbian students are a protected minority.
Hudson tells ParentDish courts are more clear on the wearing of the Confederate flag. It is considered protected expression, he says, unless schools can prove it will inflame racial tensions or otherwise substantially disrupt the school days.
The bottom line is that teachers and administrators can't cherry pick the opinions they will allow to be expressed. The guiding principle on such matters was decided by the U.S. Supreme Court in the 1969 case of Tinker vs. Des Moines.
Justices ruled students could wear black armbands in protest of the Vietnam War because school officials already allowed students to wear political buttons and exercise other forms of expression.
In a video recorded of this week's community forum, McDowell tells the school board the boy he tossed out of class is not bad. In fact, he adds, that's what worries him.
He says he wonders why the kids he ejected felt safe expressing views against homosexuality.
"That's on us," McDowell says. "We have to create an environment in these schools that makes it safe for everyone."
Root says district officials in Howell hope to use this incident as a teachable moment.
"We hope we can move on from this discussion and look at district polices on bullying and harassment," she tells ParentDish.
Educators find themselves on a perpetual tightrope, she says. Certainly gay students need to be protected from bullying, she adds, but people's First Amendment rights also have to be protected.
"There are some things that are obviously hate speech," she tells ParentDish. "Other things are obviously not."

He is entitled to his opinoin just as you and others are entitled to yours That is a guarenteed right! If his religion teaches that Homosexuality" is wrong, why does he have to quit believing that? PEOPLE can disagree without HATRED being involved.

as far as his parents go, they should be proud they have raised some one who is not afraid to express their opinoin., unlike you who seems to want to spread HATRED unless they agree with you.

I am not against gays or their equal rights however it sounds like this kid that got thrown out of class was just voicing his opinion again a right that every person has. No where in this video does it say that this kid threatened or harrassed anyone. And for that reason alone I agree with the school board. The teacher does have to obligation to all students right of sexual orintation yet also to the right of free speech so long as that speech isnt threatening or harrassing. the kid that got thrown out of class was not demeaning or threatening the other kid, just voiceing his opinion.

It's one thing to not allow kids to pick on other kids because of something like that, but it's another to throw the kids out of school who disagree with him. This is not about bullying; rather, it's about this teacher's self-righteous crusade to force everyone to agree with him on sexual orientation. bbnj said...The first amendment does protect free speech. However, it doesn't matter what was said or who believes what. The Supreme Court has almost always upheld that if something is going to disrupt the learning in the classroom it can be removed. So the question is: Was the discussion part of a learning experience or students interrupting and disturbing instruction?

It is known fact by psychiatrists that PEDOFILES are not gay....but sick people who like kids...So it is very wrong for peopel to say that...and in a school where bullying is now so prevalent...The teacher is trying to stop hatred and ignorance..which is something the poster shuld learn

Sammy said...I would agree with your statement that hate speech is hate, no matter how calmly it is said or whether or not religious doctrines back it up. However, I disagree that simply stating that one does not agree with a particular lifestyle is hate. Nowhere in this article does it state that this kid made any threats against gay people, nor does it say he used any slurs in referring to homosexuals. Also, it doesn't sound like he was going on and on ranting about homosexuals and shooting them down. He simply heard the teacher out, and stated that he still disagreed.
The fact that he got in trouble for disagreeing should have all of us fired up and worried about our freedom of speech, though.

Tina said...What is so disturbing about this situation is that in one sentence, the teacher wonders why a student "felt safe" speaking out about something he believed....as if it were only right that he SHOULDN'T feel safe. Then in his next sentence, he says that all students should feel safe expressing themselves. Obviously he doesn't believe that second part; he means that only students who follow certain prescribed viewpoints should be able to feel safe, even from the consequence of getting kicked out of class, when they are, as he himself admitted, calm and behaving well. How anyone can NOT see the inconsistencies here is just mind-boggling. And no matter that the student who is defending him did so with a gross exaggeration (at best)....lies don't seem to matter to some people as long as they get their way.

Butterfly said...If for no other reason, the child should have been dismissed for argumentative behavior. The classroom is for learning, and an ECON class is all about what moves the world. One sided arguments are normal for a class of this age, and should be dwelt with on a case to case bases. If this teacher felt the class was not going to focus on the curriculum for the day because of disruptive behavior, I feel he had every right to excuse the child. Why should my child in this class be denied the education our government says he should have because one child wants to be in a bad mood and disrupt the learning progress?

Grow up! At least your children, around the age of 10 or 11, are able to wrap their heads around the fact that Santa Claus couldn't possibly do the things that they were told he did from 2 yrs old and up. You put your life in the hands of Neanderthal writers, who dwelled in completely different times, where stupidity and ignorance in regards to the world around them reigned supreme. Get a life!

It seems that if you don't agree with something you should be able to express your ideas. At least that is what I thought free speech was. The Purple shirts are as much a statement of a belief as the flag belt was. If a person asked why one group can ware a symbol of there beliefs an another can not I see nothing wrong with the question. If that person dose not share the belief that being GAY is correct why are they punished for stating their belief when others are openly stating their support? First Amendment rights?
