California Considers Expelling Kids for Sexting

He could get expelled, NBC News reports.
The California Assembly is considering a bill to enable schools to expel students who send naughty pictures on their cell phones. The bill passed the state Senate June 7.
The bill is sponsored by state Sen. Ted Lieu, D-Torrance, and defines sexting as "sending or receiving sexually explicit pictures or videos electronically."
That leaves some gray areas, NBC reports.
For example, could a student be expelled for sending photos of a Playboy centerfold or other body parts other than his or her own? What if the offense occurred off school grounds?
There could be a lot of empty seats in class if school officials nab everyone. Studies show as many as one in five California teenagers have sent or posted nude or semi-nude pictures and videos online, according to NBC.
Lieu tells the network that high school students have enough hormone-related problems without adding sexting to the mix.
Meanwhile, the American Civil Liberties Union opposes the bill as an assault on teenagers' freedom of expression and right to privacy.

dawn said...really the school will take the phone and the spoiled little kids will get a new phone from mommy and daddy. Then daddy will sue the school for taking the phone in the first place. I would rather see these kids arrested and labled for life as a sex offender. If this seems harsh it is but if you want to play as a adult pay the price.If a adult does this and is caught they are going to jail and after they will be labled for life. the lesson is you have choices make a good choice for the furture. It would be nice to see teachers doing thier job and not the part of cell phone monitor.

Angiebaby said...Schools need to get back to the business of teaching, and parents need to get back to the business of parenting. If teachers take away the phones when they catch students using them in class, this relieves the school of having to investigate or interpret what the student was doing on the phone. If you break the rule, doesn't matter what you were doing on the phone, I'm taking it, and now let's get back to the business at hand. If you are in the 9th Grade and send someone a pic of yourself in your bra and panties, this is not a reason to be expelled from school. It is, however, a reason for parents to take action. And I certainly do not think it is a reason to be labeled a sex offender.
Personally, I think schools should have some type of scrambler to prevent cell phone use during school hours. Computers have cables and the teachers, office personnel have land lines. But than, I'm old, so common sense answers are usually my choice over popular opinion.

kris said...ACLU came along originally to protect the "rights" of the communist party in America.Those people are one of the biggist problems in todays society. What we need to do is force its abolishment by law. High school students nor anyone for that matter have any right to transmit their trash thru any kind of media. I would imagine there is a place in hell for those who try to defend such behavior.

David said...Okay, why are kids even allowed to use cell phones in class? I would think while they are in a class they are involved in classwork. It seems that the teacher would be able to see when a kid is texting and stop them. Make it a rule ofr the school...no texting in class.

I'm a student and I see kids all the time texting and using their phones in class and unfortunately when teachers see them most of the teachers just warn them. In the classes I'm in almost nobody gets their phone taken away. I'm a senior in high school and not suprisingly, I see it more in the younger kids. A.k.a freshman and sophmores andn I think it's gunna get worse as the years go on unless there are more laws against stuff like this.

Teenagers don't get freedom until they are 18 and out of the home. I see these articles all the time about how horrible kids are. They aren't so bad, their parents set a bad example.

Lew said...Sexting is not a school problem....Education is a school problem. It is a parent problem. Parents get their kids these expensive phones to be the kids buddy and not their parent. They allow the plans that can give them all the options they want. And the parent buys all this to be the kids friend and not the parent. The school is not the parent....My son has a phone but he has NO extras. Can it take pictures yes but all phones now do that but I can control what he does and does not get to use. Why because I am his parent not his friend.

I just got a phone for my son at fourteen-he's the next to last of his friends to have one-and it's so I can get ahold of him, not so he can play, talk to friends, text, take pictures, etc. I love my child but i am not his friend, i am his parent. Most of the time, if your kid likes you, you're not doing a good job and i don't mind because i know he'll be responsible for his actions and think about the things he does because he sees the consequences behind every decision and knows he will be paying them!!

John said...If any of these type of emails were received by mistake by an adult, that person would be guilty of receiving Child Pornography. I think that this is the best policy, it will hold the kids accountable. Also hopefully teach them to respect themselves. I said hopefully!

I mean if the kid with a crush on me, send me a sext, I can delete, but what if they do random checks and Zi haven't even looked at my texts, cause im in class obeying the rules. No cell phone use in class.

NURSE 187 said...When I was in school, if my parents needed to get a hold of me, they called the school office! NO PHONES IN SCHOOL! Also, expelling is vacation for some kids and lawsuits from their parents. WHY dont you make them do mandatory community service at a senior center?! OR, a tour of the jail to see what can happen if you dont learn to obey your parents or your school authorities! And YES!.....I believe in school uniforms for ALL SCHOOLS! Stop the crime and the bullying!

EXPEL all the so called "role model" celebrities that bare all and do all and say all!!!!!!! When in grade school in a one room school, in the 1930's, all of the boys carried our rifles (22 cal) to school and stod then in the corner of the room. We used them to put meat on the supper table. There was no trouble with misusing the guns they were tools used to furnish meat on the table and we all knew the proper use of same. We respected human life. There was also wild hemp (marajuana) along most all stream banks yet we never toutched it.

Then why does the state have the authority to charge them as adults. You can't (or at least should) have it both ways, treat someone as an adult in the criminal justice system AND not give them the same 1st/4th/5h amendment rights that adults get.

Sheesh....too bad the ONLY thing you don't need a liscence for in this country is being a parent.
