Judge to Mom: 'You Don't Spank Children'

To spank or not to spank? At least one judge says don't even go there.
No, Rosalina Gonzales wasn't put behind bars for spanking her toddler, but prosecutors and a judge in Corpus Christie, Texas, let it be known that whacking a kid on the rear will land parents in hot water -- and possibly prison.
KZTV, the local CBS affiliate, reports Gonzales was arrested last year for Injury to a Child after her then 2-year-old's grandma took the girl to the hospital after spotting red marks on her behind.
Gonzales plead guilty this week, according to the station, in exchange for serving five years probation, agreeing to take parenting classes and paying $50 to the Children's Advocacy Center.
"You don't spank children today," 214th District Court Judge Jose Longoria told Gonzales, KZTV reports. "In the old days, maybe we got spanked, but there was a different quarrel. You don't spank children. You understand?"
Gonzales is trying to regain custody of her two children, including the one who was spanked, according to the station, but they will stay with their paternal grandmother until the state agrees her home is safe.

jeannette said...I grew up with spankings, respect for others and their property. So were my children.We are capable, prductive adults who respect and love each other and do what we need to do to help where ever and when ever we are needed. I'm sure I'll hear it from a lot of people,but here goes. A little swat now and then never hurt any one.

I thought I was going to get into a big argument about spanking but all of you agree with me or I should say I agree with you. I am amazed. No argument here. The judge is over stepping his authority & if this was appealed the mother would win. YOUR POST WAS GREAT!

johnC said...You are absolutely right on. I am a pediatrician. Why is the child spanked? Many need a quick swat to the behind for doing dangerous things, ie running out into the street. A swat now may prevent a dead toddler later. Rules are to be enforced at home, if possible without physical contact, but sometimes it is necessary to get the child's attention that you as the parent are the final "God's" authority. When they go to school, the teachers and principal are the authority. They should be able to impose significant penalties for significant misbehavior. And finally the Police and Courts will be respected instead of the child spending his 20's in the pen. The unknown question is why did the mother spank the child. ?? Sometimes it is needed and sometimes another approach is needed.

Wes said...I agree 100%, today in the U.S. it's like living in Communist Russia, we can't do anything with our children without someone rating us out. My children were spanked and disciplined, toys taken away, etc. but never to the extreme. Both turned out well and there children are doing great also. We as a society must have some discipline and show respect for others otherwise, our system will continue to decline. I also agree that the judge was nuts.

Deb said...I agree with dougalcandy. My 2 children grew up with spankings and respecting others. They are in there 20's now and have both graduated from college and on to jobs. I feel not being able to disciplining a child is hurting that child more. Im not saying to spank them so hard it hurts them. A bop on the bottom or a tap on the hands doesn't hurt anyoneand gets their attention. They learned that that things shouldn't be touched. Many kids today are out of control and so many have both parents working it's also hard for the parent when they have other people helping to raising the children. Children get mixed signals on what can and can't be done at early ages. Even though my kids are older and do not live at home they still come to the house once a week for a nice sit down family dinner. I was able to stay home with my children and raise them and yes siblings do argue and fight, we didn't have the perfect family but I love my children and would do anything to have them young again and be able to raise them and teach them the importance of the ways of the world once again.

Babygirl said...I TOTALLY agree with you. I remember when I was having problems with my daughter and had to go before a Juvenile Court judge. She had the nerve to tell me that I should not spank my child, that I should set her down and talk to her, put her on punishment and on, and on and on. I finally got tired of her telling what I should and should not do in rearing MY child. I asked her if she had any children, she responded no. I then said, and I quote...."How in the hell can you tell me hoe to raise my child, Until you have walked in my shoes, don't even try it". I also told her she can bring my daughter home with her since she was such an expert on child rearing. Needless to say, my daughter came back home with me and her father. If you haven't had the experience, what makes you experienced?

old enough to remember said...These problems were brought about by psychologists who felt we should coddle a child's ego. Children were not supposed to fail as it would hurt their self-esteem. When they get into the workplace, they cannot cope with failure. If you are in a store and your little one acts up, people will either say you are a bad parent for telling them to quiet down or you are a bad parent for letting them scream. Now some of these same idiots (who need to get therapy themselves) are saying its the parents' fault that the kids are the way they are. Beating a child black and blue is wrong, but so is letting them get away with everything.

Judge Longoria is and sees how dead wrong he was, by siding with these wayward kids, of today. Parents who try to raise their children, properly, do not have a chance of instilling in them what is important...respect, being one of them. Were I young today, there is not a chance I would have children, by choice! Stripping parents of their rights doesn't make this Judge many friends. I would guess, but never know, that Judge Longoria is no older than 30 or 35 at most! Thanks! Again...

Kathy M. said...You're right on target dougalcandy! I had 6 children and I smacked every one of them by the time they were 2 years old if they needed it. I didn't abuse them but by god I brought up 6 very respectable law abiding citizens that do contribute to society in there work and with there behaviour! (It sounds to me like the 'grandma' maybe doesn't care for the mother of this child, I would have questioned that as a judge!) No wonder kids are so out of control and dysfunctional these days! They have no boundaries and are a bunch of undisciplined spoiled whiny selfcentered brats!
